Harris Companies, Inc. Warranty Information

Harris makes no warranties, whether express or implied, except as provided by Harris herein. Harris warrants only that products furnished to customer will be free of defects in material and workmanship for a period of (a) twelve (12) months from installation, or (b) eighteen (18) months from the date of shipping by Harris, whichever comes first. Upon written notification and in the event Harris determines that any product is defective, prior to expiration of the warranty period, Harris’ obligation shall be limited to, at its sole election, refund of the purchase price of, or repair or replacement of, the defective product. Such replacement, repair or refund shall constitute the sole and exclusive remedy for any defective product. Harris makes no other warranties, express or implied, including any warranty of merchantability or fitness for a particular purpose. In no event shall Harris be liable for any indirect, contingent, consequential, incidental or special damages, whether in contract (including breach of warranty) tort (including strict liability) and including but not limited to lost profits or other economic loss in excess of the cost to repair or replace any defective goods. Harris is in no way responsible for any contingent and/or consequential costs as to the cost of installation of, replacement or repaired parts, travel expenses or any other expense incurred in connection with the replacement and/or repair. Harris’ maximum liability shall in no event exceed the purchase price of any particular goods sold hereunder which are shown to be defective. No warranty shall apply to any product which has been subject to misuse; misapplication; disassembly, neglect; improper storage, installation, maintenance, lubrication or repair; use or attachment to other facilities or equipment; or acts of God. This warranty is void if the failure is caused or contributed to by any of the following: a lack of a documented preventative maintenance program performed on at least a monthly basis by a licensed, experienced elevator contracting company; the equipment is used by construction personnel during plant construction; the equipment is not installed by a licensed, experienced elevator contracting company; improper shipping. Repair or replacement of parts furnished under the terms of this warranty is only warranted for the remainder of the original warranty period. If Harris determines that the product is out of warranty, an estimate of repairs will be provided to the customer; in which case a purchase order will be required prior to completing the repairs. This warranty is a limited warranty and shall be in lieu of any other warranties, express or implied, including, but not limited to, any implied warranty of merchant ability or fitness for a particular purpose. There are no other warranties, which extend beyond the description or the face hereof.

Any warranty provided by Harris is specifically contingent upon customer entering into a written maintenance agreement with Harris or providing written documentation that the customer has complied with the maintenance requirements provided by Harris.

HARRIS MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
